1. General
These general terms and conditions apply in applicable parts (in accordance with what is stated herein) when you use services provided by Frink AB, Reg. No. 559059-8420 (“Zaver” or the “Company”) through the brand Zaver. You may only use our services if you are of legal age and in your capacity as a private individual.
We recommend that you carefully read this document before using Zaver’s services and contact us if you have any questions.
Zaver is authorized to conduct operations pursuant to the Swedish Act on Banking and Financing Business (2004:297) (Sw. lag om bank- och finansieringsrörelse) under the supervision of the Swedish Financial Supervisory Authority, Box 7821, 103 97 Stockholm, Sweden. These general terms and conditions do not apply to the services the Company provides within the scope of its licensed activities conducted in accordance with the Swedish Act on Banking and Financing Business, such as the provision of payment services, credit issuance or savings accounts, or services provided by third parties (see section 4 in particular). If you choose to use such services, you will be presented with and asked to accept separate terms and conditions for the specific service in question, which take precedence over and are not affected by these general terms and conditions.

2. For those who create a user account
The terms in this section apply if you create a user account (“User”) with Zaver through our app or website.
2.1 Basic requirements
By registering as a User, a unique user account is created. The user account is personal and may only be used by you, and you are solely responsible for all actions performed via your user account. When using our services, you are required to provide accurate information and use your real identity. Use of our services in a manner not prescribed will be considered misuse.
2.2 Immediately report unauthorized use
You must not disclose your login details to any unauthorized person, and no one other than yourself may use your login details. You must notify the Company immediately if you suspect that an unauthorized person has gained access to your user account, BankID, BankID authentication code, or other information that enables or facilitates unauthorized authentication to Zaver. You are responsible for all actions taken with your login details. You are also responsible for securely storing and protecting your login details.
2.3 Registering a bank account number
Through our services, you can register one of your associated bank account numbers. Users who register a bank account may only register an account for which the User is the sole principal. The bank account may not be one that has been set up or provided by the account-holding bank for use by a legal entity, business, association, foundation, or that is otherwise used for banking transactions other than those of the principal's private transactions. By registering a bank account, you certify that the registration is compatible with these terms and conditions. The Company is never liable for damage or inconvenience arising from your providing of incorrect, outdated, or otherwise inaccurate bank account information to the Company.
In cases where you are to receive a payment via or from Zaver, you are responsible for ensuring that the bank account details you provide or confirm are correct, complete, and up to date, and that they meet the requirements set out in the paragraph above.
2.4 Electronic communication
By accepting these terms and conditions, you agree that Zaver may provide you with all communications, such as payment information, invoices, terms and conditions, information we are required to provide by law, and other information, electronically. Information provided electronically will be provided via our website, app, messaging function, the email address you have provided to us, and/or text message. You are responsible for ensuring that we have your current email address and mobile phone number so that we can communicate with you electronically. If you need to update your primary email address, you can update your email address in our app or contact customer service to make the change.
2.5 Termination of user account
You have the right to deregister as a User of the Company at any time. The terms and conditions in this section 2 will then cease to apply immediately. If you have used other services provided by the Company, we may retain certain information about you after your account has been terminated, in accordance with our Privacy policy.
3. For those who use our platform
The terms and conditions in this section apply if you use Zaver’s platform, either by registering as a User and/or by using our checkout, i.e. our technical solution for making purchases from affiliated merchants (the “checkout”). For the avoidance of doubt, these terms and conditions do not apply to any underlying purchase made through our checkout. If you choose to make a purchase through Zaver's checkout, you will be presented with and required to accept separate terms and conditions for the payment, which take precedence over and are not affected by these terms and conditions.
3.1 Zaver's right to block services and withhold payments
The Company saves, monitors, and may review and investigate all interactions between you and the Company. This is done to prevent fraud, other criminal activity, and to prevent our services from being used in violation of these terms and conditions or any other agreement between you and the Company. Monitoring and review are carried out both automatically and manually. As part of such measures, the Company may request information from you regarding your use of the Company's services. Any information related to abuse or suspected abuse may be stored and used for future risk assessment and as protection for the party or parties concerned. Further information about the Company's processing of personal data and your rights can be found in the Company's Privacy policy.
Zaver reserves the right to block you from accessing all or part of the Company's services and to withhold funds managed on your behalf in the event that there is suspicion that you have provided incorrect information, are using our services in violation of applicable terms, or are otherwise using our services in connection with criminal activity. The Company reserves the right to request additional information from you in order to fulfill our obligations to combat money laundering and terrorist financing.
3.2 Data protection and processing of personal data
The Company needs to collect personal data in order to offer you our services. In our Privacy policy, you can read about what personal data is collected, for what purposes the personal data is processed, how we protect your data, and how you can exercise your rights.
If you apply to use a service that involves credit being granted to you by us, the relevant merchant, or another third party (where applicable), or if you use the feature “check your purchasing power” (Zaver Precheck), you understand that the Company and/or its partners may obtain a credit report via a credit reporting service provider.
If you share information about yourself with us, for example via our app, email, or chat function, entailing that we process information regarding political opinions or philosophical beliefs, trade union membership, health or sex life (so-called “special categories of personal data” according to EU Regulation 2016/679 (“GDPR”)), you consent to our processing of that data in order to perform our services.
3.3 The Company's liability and availability of services
The Company does not guarantee that all functionalities offered through our services will always work and is not responsible for any loss or damage, whether direct or indirect, that may be caused as a result of our services or any technical system on which they depend being unavailable due to operational disruptions, maintenance, or other communication disruptions at the Company or a third party, or due to delayed processing due to necessary checks or other technical errors. The Company is never liable for damage or inconvenience arising as a result of a subcontractor's negligence, lack of cooperation, or inability.
The Company is not liable for damage or inconvenience resulting from failure to fulfill any of its obligations to you under these terms and conditions if the failure is due to an obstacle beyond the Company's control and the Company could not reasonably have been expected to foresee, avoid, or overcome the obstacle and/or its consequences. Furthermore, the Company is not liable for loss or damage caused by a country's legislation or decisions by authorities, subcontractors’ decisions or inability, acts of war, interruptions in the public communication system, strikes, blockades, boycotts, lockouts or other similar circumstances (force majeure). The reservation regarding strikes, blockades, boycotts, and lockouts also applies if the Company itself is subject to or participates in similar conflicts. If any of the aforementioned types of events prevent the Company from carrying out transactions such as payments or other transactions, the Company shall carry out the transaction once the obstacle has ceased. Furthermore, the Company is not liable for damage or inconvenience arising from your providing of incorrect, outdated, or otherwise inaccurate bank account information to the Company. What is stipulated in this section does not apply in cases where the Company is liable for loss or damage in accordance with applicable law.
3.4 Intellectual property rights
All intellectual property rights, such as copyrights, patents, and trademarks, as well as all other rights to the content on Zaver's website and app, are owned and held by Zaver. Your use of any of Zaver's services does not mean that any intellectual property rights are transferred to you. Logos, trademarks, and other distinctive features appearing on Zaver's website or app, or otherwise used by Zaver, belong to Zaver or third parties and may not be used by you without express consent.
4. Responsibility of external parties
4.1 Merchant's responsibility for products and services
The Company's checkout is used to make purchases from affiliated merchants. Zaver has no responsibility for the merchant's obligations prior to the purchase, during the purchase, or as a result of the purchase. This means that the Company has no responsibility if, for example, you do not receive the product or service agreed upon with the merchant. Nor can the Company guarantee, vouch for, or take responsibility for a merchant fulfilling its obligations to you. The above is not intended to limit or exclude any rights you may have or obligations the Company may have towards you under mandatory consumer legislation.
4.2 For those who obtain credit directly from a merchant
The Company acts as a technical provider for merchants who offer consumers the option of making credit purchases on invoice and/or in installments through credit issued by the merchant. If you choose to make a payment by obtaining such credit from a merchant, the merchant is responsible for providing the credit. Zaver is not responsible for credit issued by a merchant. In such cases, the terms and conditions for the credit are provided by the merchant in question, through the Company's checkout and/or any other channel of the merchant. Under no circumstances are the credit terms affected by these general terms and conditions.
4.3 For those who use payment services provided by third-party providers
The Company acts as a technical provider for payment service providers by providing technical integration to merchants. If you choose to make a payment using an external payment service provider, that provider is responsible for the payment service and its execution. Zaver is not responsible for payment services performed by third parties. In such cases, the terms and conditions for the payment service are provided by the payment service provider in question, through the Company's checkout and/or any other channel of the provider. Under no circumstances are the terms and conditions of the third-party provider affected by these general terms and conditions.
5. Miscellaneous
5.1 Assignment or transfer
Zaver has the right to assign or transfer the rights or obligations under these terms and conditions to a related company to Zaver and/or third parties. You have no right to assign or transfer any rights or obligations under these terms and conditions.
5.2 Adjustment
If any provision of these terms and conditions, or any part thereof, is found to be invalid, the remainder of these terms and conditions shall remain valid. In such cases where the invalidity affects any party’s exchange or performance under the terms, reasonable adjustment in the terms shall be made.
5.3 Compliance with applicable law
You are solely responsible for complying with all laws and regulations that may be applicable to you in connection with the use of the Company’s services.
5.4 Complaints
Your satisfaction is Zaver’s highest priority - if you are not satisfied, we are happy to help. You can file a formal complaint if you believe that we have committed an error in the handling of your case. Zaver has a complaint manager and follows the Swedish Financial Supervisory Authority’s general guidelines on complaints management concerning financial services to consumers and the Swedish Financial Supervisory Authority’s regulations regarding complaints management.

In the event of a dispute with Zaver, a consumer has the opportunity to contact the National Board For Consumer Disputes, Box 174, 101 23, Stockholm, Sweden (www.arn.se). You can also take your complaint to a general court. Free guidance can be provided by the municipal consumer guidance or by the Swedish Consumers’ Banking and Finance Bureau, Box 24215, 104 51, Stockholm, Sweden (www.konsumenternas.se).
